This rule gave many players a comeback situation but also downfall too. This thing happened to me yesterday in a fide rated tournament were I was literally winning the game and lost because of that touch to play move.

I would choose the first option as I'm a respectful player [Kind of] . But the logical reason is that it make stalemating idea higher.
