IMHO losses against a ToS violator should be considered a draw instead of a win in a tournament; the reason being that one cannot know for sure what the result would have been had the violator played honestly.

But that's just the way it is here. The problem is, it only applies during the tournament, not after. Although it makes no difference.

If someone disagrees with a ban, the process for it is an appeal. Discussing it in forum does not bring any good as people (except, possibly, moderators involved) do not have the information needed to discuss it meaningfully.
